01

Learn the main idea

Shirkah involves joint business participation, while mudarabah combines capital from one party with work from another. Profit sharing must be agreed; losses follow legal rules.

02

A deeper explanation

Shirkah refers to partnership arrangements in which participants combine capital, work or other recognised contributions according to legal rules. Mudarabah joins an investor's capital with an entrepreneur's management. The profit-sharing ratio must be agreed in an appropriate form; guaranteed fixed profit for a capital provider can change the legal character of the arrangement. Ordinary business losses are generally borne according to the relevant rules, while negligence and misconduct may create liability.
