Mahr, Rights and Mutual Duties

Mahr is the wife's enforceable right, not a purchase price. Spouses have mutual duties of respectful treatment and rights governed by Islamic law.

By the end of this chapter, explain the central terms of Mahr, Rights and Mutual Duties; distinguish the main claim from its supporting evidence; apply the concept to a relevant case; and identify an important limitation or misconception.

Hanafi legal method: identify the parties, legal capacity, operative words or acts, conditions of validity, legal consequences and exceptions. Do not confuse a recommended practice with a validity condition. Family and inheritance cases require accurate facts, qualified legal advice and attention to applicable civil law.

In Hanafi law, begin with the facts. What happened, who is affected, and which conditions change the ruling? A general scriptural principle is not the same as a complete legal decision. For marriage, divorce and inheritance, do not apply a classroom example to a real family without a qualified scholar and the applicable civil law.
