Gharar involves excessive uncertainty in a contract. Deception and serious ambiguity about goods or price undermine fair consent and may invalidate transactions.
Gharar denotes serious uncertainty that affects a contractual exchange. The concern is not every small unknown detail but uncertainty substantial enough to create unfair risk or dispute. Tadlis involves deception, while jahalah concerns ignorance about essential contractual terms. Classical jurists analyse the object of sale, deliverability, quantity and price to determine legal consequences. Modern transactions must be assessed by their actual terms rather than judged solely by commercial labels.
